GIFT CARD TERMS OF USE - EL GANSO

General Terms: These Terms of Use ("Terms") apply to the acquisition and/or use of the El Ganso Gift Card (hereinafter referred to as the "Card") purchased on this website (hereinafter "e-shop").

The Card is the property of its issuer, ACTURUS CAPITAL, S.L. (hereinafter referred to as the Company) with its registered office at Calle Impresores, 4, Polígono Prado del Espino, Boadilla del Monte (Madrid) and VAT number B-83233346, with the holder or recipient being a mere holder of it. The Company reserves the right to modify these Terms and temporarily suspend its use for technical or updating reasons.

Card Purchase: The Card can be purchased on this e-shop in digital format. Vouchers, gift tickets, loyalty points, as well as discounts and/or promotional codes, can be used for Card acquisition. The purchase of the Card accumulates loyalty points for the person purchasing the Card if they are registered as a customer in our database; however, no loyalty points are accumulated for the person receiving the Card as a gift. The Card will be issued for a minimum amount of €20 and a maximum of €500.

Functionality: The Card does not expire and grants its holder the possibility to purchase, based on the balance available on it, any garment and/or accessory currently for sale on the e-shop of the country where the card was acquired. It cannot be used for purchases in physical stores of El Ganso, department stores, or in the e-shops of other markets/countries/regions.

The Card can be used to make desired purchases until its balance is exhausted. In a single purchase, more than one Card cannot be used, nor can it be combined with discount or return vouchers. The Card balance will decrease as it is used to buy garments and/or accessories in the aforementioned stores. If the total value of the purchased products exceeds the total amount on the Card, the remaining balance for those products can be paid using any other accepted payment method. The available Card balance can be checked in the account the holder has on the e-shop.

The Cards will have a barcode and an alphanumeric code for use.

Delivery: Delivery is made to the email address indicated by the person who purchased the Card. The Company will process the personal data of the recipient in accordance with our privacy policy.

It is the responsibility of the person purchasing the Card to ensure that the contact details of the recipient entered during the order are correct. The Company is not responsible in any case if the recipient does not receive the Card due to an error in entering their contact information. Similarly, the Company is not responsible for the non-reception or delay in receiving the Card by its recipient due to: (i) deficiencies or the collapse of telecommunication lines or systems; (ii) the inability to deliver the Card to the provided email account; (iii) the consideration of the sent email as spam or unwanted mail.

Right of Withdrawal: The person who purchased the Card has fourteen (14) days from the date of shipment by the Company to the recipient of the Card to exercise their right of withdrawal without having to indicate the reason and without incurring any cost, provided that the Card has not been used in whole or in part.

The Company will refund the Card purchaser the full amount received without undue delay and, in any case, before fourteen (14) calendar days have elapsed from the date the withdrawal was communicated. The refund will be made in the same payment method used in the purchase. Returns of Cards purchased in e-shops of other markets/countries/regions are not accepted.

To exercise the right of withdrawal, it is necessary for the Card purchaser to notify the decision to withdraw from the contract through an unequivocal statement. To facilitate the exercise of this right, the Company provides a withdrawal form that can be downloaded from the e-shop, although its use is not mandatory.

Returns: The return of the Card is accepted within the same deadlines and conditions established in the previous section. Gift Cards cannot be exchanged.

Returns of garments and/or accessories purchased with the Card are subject to the same exchange and return policy as the rest of our garments and/or accessories purchased on the e-shop of the country where the Card was acquired. It is expressly stated that products purchased through the Card are not eligible for cash returns, with the refund amount being reimbursed on the same Card. The Card balance is non-refundable, either in whole or in part.

If a Card and another alternative payment method were used at the time of purchase, the original amount corresponding to each of the payment methods used will be refunded.

Responsibility: The holder undertakes to preserve and use the Card correctly, being solely responsible for its use and custody. Loss, theft, or misuse of the Card will not result in a refund or replacement under any circumstances.

Data Protection: The personal data provided by you will be processed by the Company, whose details are reflected in these Terms and, for the purpose of managing the Card, the legitimizing basis being the contractual execution. To comply with our legitimate interest in maintaining centralized customer management, we may communicate your data to other companies in the El Ganso Group. Your identifying and contact data are the subject of processing. If you provide personal data regarding third parties, you guarantee that you have informed them of the content of this Privacy Policy and, where applicable, that you have obtained their prior consent to provide us with their personal data, for the purpose of processing the same.
